Senator Rubio’s letter to Secretary of Education Duncan: Common Core Standards are illegal

In September of 2011, as the Common Core State Standards were being completed, Senator Marco Rubio wrote a letter asking Secretary of Education Arne Duncan to justify his program, since there were at least three laws stating that such a program was illegal.

In the letter he cites three laws that are violated by the Department of Education’s plan to create national curriculum standards and assessments:
- The No Child Left Behind Act [Scroll down to section 9526]
- The Department of Education Organization Act [Give this a moment to load. ( See page 5)]
- The General Education Provisions Act.
“All three laws prohibit the federal government from creating or prescribing national curriculum,” Rubio’s letter states.
