No Child Left Behind does not mandate that the WASL (or HSPE) be a graduation requirement. It was decided in Olympia.

If you wade through the two-inch thick law which is No Child Left Behind, you will see that the federal law does not require the state assessment to be used as a graduation requirement. That decision is left to each state. If you wish to change the high-stakes nature of this assessment, talk to your state legislator and the Superintendent of Public Instruction.

‘‘(l) CONSTRUCTION.—Nothing in this part shall be construed
to prescribe the use of the academic assessments described in
this part for student promotion or graduation purposes.”
